What is the workers’ compensation process?

Workers’ compensation provides financial support and medical care to employees who suffer work-related injuries or illnesses. 

Navigating the workers’ compensation process in Pennsylvania can seem overwhelming, but understanding the essential steps can help make it more manageable. 

Reporting the injury

The first step is to tell your employer about your injury right away. You must notify your employer within 120 days of the injury. 

Failing to do so may result in losing your right to benefits. Ensure your report is detailed, including when, where, and how the injury occurred.

Seeking medical treatment

After reporting the injury, seek medical treatment promptly. Your employer might have a list of doctors you need to see for the first 90 days. Ensure you follow the prescribed treatment plan, as non-compliance can affect your claim.

Filing a workers’ compensation claim

Your employer should give you a workers’ compensation claim form. Complete and submit this form to the Bureau of Workers’ Compensation. Include all necessary documentation, such as medical records and accident reports.

The claims process

Once your claim is submitted, the insurance company has 21 days to accept or deny it. If accepted, you will begin receiving benefits, including wage loss compensation and medical coverage. 

If denied, you can file an appeal with the Workers’ Compensation Appeal Board.

Receiving benefits

Benefits depend on how serious your injury is and how long it lasts. They can include temporary total disability benefits, partial disability benefits, and medical benefits. 

Make sure to keep detailed records of all medical treatments and communications with your employer and the insurance company.
